Terms and conditions for Datacom “Salesforce SmartStart GO and GROW Promotion”

By participating in this “Salesforce SmartStart GO and GROW Promotion” (“Promotion”) you will be deemed to have accepted these Terms and Conditions. Datacom Systems Limited is the “Promoter” of this Promotion. Our office is located at 58 Gaunt Street, Auckland CBD, Auckland 1010 (“Datacom”, “we”, our” or “us”).

Who can enter?

1. This Promotion is only open to New Zealand registered businesses holding a valid NZBN.
2. You may not enter the Promotion if you are: (i) our employee or are anyone working for our agencies or suppliers that are associated with the Promotion; (ii) anyone else who we may have previously told in writing that they cannot enter; and (iii) any family members of (i) or (ii) above.

Promotion period

1. This Promotion commences at 8.00am on Tuesday 1st August 2023 and ends on 31 March 2024 or, if earlier, as soon as 10 x SmartStart GO packages are contracted with Datacom (“Promotion Period”). Entries received after this end time will not be eligible for entry.
   

How to enter

1. To enter, during the Promotion Period, you must contract directly with Datacom for a Salesforce SmartStart GO Sales, Service or CRM Package. This will be considered a “valid entry”.
   
2. We collect personal information about you in order to run the Promotion, communicate with you, and award prizes. We may also share your personal information with third parties who support us in this Promotion. We will handle all personal information you provide us in accordance with our Privacy Policy. We may contact you or send you promotional or other material or information we may think you might be interested in. You can opt out of this at any time by letting us know. If you have any concerns, please just contact our Privacy Officer as set out in the above link.
   

Selection of the winner

1. This Promotion is a game of chance. There will be one winner drawn from valid entries received. The prize draw will take place onsite at Datacom, where entrants will be invited to a cocktail evening where project highlights will be shared, and the winner will be drawn. This event is expected to be scheduled in November 2023. If a minimum of five (5) valid entries are not received by [31 October], the Promotion may be extended and/or the event may be postponed.
   

Prize

1. The prize is a 100% refund of the implementation services costs (excluding Salesforce licensing costs) the winner has paid to Datacom in respect of its SmartStart GO implementation. Note that if the winner purchased a SmartStart GO and GROW package, then the amount refunded would be for the total amount paid for both the SmartStart GO and GROW packages. e.g
   • scenario 1: Entrant contracts for SmartStart GO Sales ($40k) only: $40k refunded
   • scenario 2: Entrant contracts for SmartStart GO Sales ($40k) and SmartStart GROW package ($30k): $70k refunded
   • scenario 3: Contract for SmartStart Grow package only – not a valid entry.

Notification and Promotion of winners

1. Where you are selected as the winner and you are not present at the event, we will notify you by email within seven business days. We may opt to publish the names of winners on social media posts and our website.
   
2. As a condition of entry you agree to allow us to use your likeness, imagery and full name on our website, in social media and editorial content where you are selected as the winner, and to participate in reasonable promotional activity.
   

General

1. A minimum of five (5) SmartStart GO packages must be contracted before a winner can be drawn.
2. Our decision is final on all matters related to this Promotion, and no correspondence will be entered into. Datacom reserves the right at any time to suspend or modify the Promotion, or these terms and conditions, without notice and for any reason whatsoever at our sole discretion.
3. We may refuse to award any prize to anyone who we (in our sole discretion) believe has violated these terms and conditions or gained an unfair advantage in participating in the Promotion or won using fraudulent means.
4. The prizes, or any portion of a prize, are not transferable, re-saleable or exchangeable.
5. You are responsible for all expenses you incur in connection with this Promotion, any taxes that may apply to prizes, and your attendance at the prize draw event.
6. We and any of our suppliers associated with this Promotion will not be liable for any damage, loss or expense (including any indirect or consequential loss) arising in connection with this Promotion, including any prize, except to the extent that liability cannot be excluded by law. Nothing is intended to restrict, exclude or modify any rights you may have that cannot be restricted, excluded or modified at law, including the statutory consumer guarantees under the Australian Consumer Law or the Consumer Guarantees Act in New Zealand (as applicable).
7. These Terms and Conditions are governed in accordance with the laws of New Zealand, and will be subject to the exclusive jurisdiction of New Zealand Courts.
